Welcome to the attaché x ltd Creator Program. We view our creators as essential partners in telling the story of Intelligent Elegance. By participating in this program, you (the “Creator”) agree to the following terms, which are designed to ensure a fair, transparent, and successful collaboration for both parties.
1. Product Gifting & Delivery
1.1 The Gift: Upon approval, Company will provide the Creator with the agreed-upon Product at no cost to support the creation of authentic content.
1.2 Delivery & Care: Company covers initial shipping and the risk of loss during transit. We will provide one (1) replacement if the courier confirms the package is lost. We ask that Creators provide a secure delivery address to ensure the safe arrival of this high-value item.
2. Content Deliverables & Timeline
2.1 Quantity of Deliverables: Creator agrees to produce the specific content assets (the “Deliverables”) as outlined in the Campaign Brief or onboarding materials provided upon acceptance.
2.2 Timeline: To ensure campaign momentum, we follow this collaborative schedule:
- Product Receipt: Creator shall notify Company upon the safe arrival of the Product.
- Creative Drafts: Creator shall submit “Finished Assets” for review within the timeframe specified in the Campaign Brief (defaulting to 10 business days if not otherwise specified).
- Going Live: Once we have collectively polished the assets, Creator shall post the content on the agreed date or within 48 hours of final approval.
2.3 Guidelines: Creator agrees to follow the “Product Presentation Guidelines” provided in the Campaign Brief to ensure the Product is showcased at its best.
2.4 OwnerLock Registration: As a core feature of our security ecosystem, Creator is required to register their ownership of the Product on OwnerLock immediately upon receipt.
2.5 Asset Sharing: To support our long-term partnership, Creator will share assets via our agreed digital folder:
- Raw Assets: Unedited footage and photos captured during your creative process.
- Finished Assets: The final edited versions ready for your audience.
2.6 Creative Alignment: We believe in a collaborative review process. Company and Creator will work together to ensure Deliverables align with the campaign’s vision. While we reserve the right to request edits or elect not to publish content that doesn’t fit the current marketing cycle, we aim to make this a smooth and creative exchange.
3. Instagram Posting & Collaboration
3.1 Collaborator Tool: For all Grid Posts and Reels, Creator shall invite the Company as a “Collaborator” using Instagram’s native feature to maximise reach for both profiles.
3.2 Marketing Rights: Creator acknowledges that Company may further support the content through “boosting” or “Partnership Ads” to increase visibility for the Creator’s handle and the Product.
3.3 Content Retention: To maximise the impact of the campaign, Creator agrees to keep approved content live for the period specified in the Campaign Brief (defaulting to 180 days).
4. Creator Program & Compensation
4.1 Tracking: Company will provide a unique tracking link or code to attribute sales to the Creator’s influence.
4.2 Follower Benefits: We love rewarding your community. If specified in your onboarding, your followers may receive a preferential offer. Company reserves the right to manage the “stackability” of these offers against other promotions to maintain program health, providing notice of any significant changes.
4.3 Revenue Share (Commission): Where agreed during onboarding, Creator shall receive a commission on Net Sales generated through their link. Specific rates and attribution windows are detailed in your Creator Dashboard.
4.4 Net Sales Defined: To keep things transparent, “Net Sales” refers to the actual revenue received by the Company, excluding:
- VAT or relevant sales taxes.
- Shipping and handling fees.
- Discounts applied at checkout.
- Returns, refunds, and cancellations.
- Credit card chargebacks or fraudulent transactions.
4.5 Payment Schedule: Commissions are processed at the end of the calendar month following the month in which the standard “free return” period for the purchase has expired.
5. Usage Rights & Licensing
5.1 Creative License: Creator grants Company a perpetual, worldwide, royalty-free license to celebrate and repurpose your content (Raw and Finished) across our digital and print marketing channels.
5.2 Whitelisting: Creator grants Company permission to support the partnership through paid advertisements using the Creator’s social handle.
6. Professional Standards & Compliance
6.1 ASA/CAP Compliance (UK): To maintain transparency with your audience, Creator must clearly disclose the partnership per UK ASA/CAP guidelines (e.g., using #ad prominently).
6.2 Authenticity & Feedback: We value your honest experience. If you identify significant negative feedback during testing, we ask that you share this with us privately first. This allows us to respond and, if we agree to publish, ensures your audience receives the full context of our response alongside your feedback.
6.3 Endorsement Integrity: We encourage “honest and unbiased” feedback. To remain legally compliant, Creator shall not claim their opinion was “uninfluenced” by the Company given this commercial partnership.
6.4 Mutual Respect: Creator agrees to maintain a professional relationship and refrain from disparaging statements regarding the Company for one year following our collaboration.
6.5 Brand Alignment: Company may conclude the partnership and request content removal if the Creator engages in conduct that fundamentally conflicts with the Company’s core values or reputation.
7. General Terms
7.1 Data Privacy: We respect your data. Both parties will comply with UK GDPR obligations. Your data is processed solely for managing this partnership and your payments.
7.2 Creative Responsibility: Creator shall ensure their content does not infringe on third-party copyrights (such as unlicensed music) and remains accurate to the product experience.
7.3 Investment Protection: We trust our Creators with significant high-value products. If a Creator fails to deliver the agreed content after receiving the Product, they agree to reimburse the Company for its full retail value.
7.4 Governing Law: These terms are governed by the laws of England and Wales, and any discussions shall be held under the jurisdiction of the courts of London.
