Terms and Conditions of Participation for“Subscribe to get attaché x Engineer’s Edition 2024 for £1” promotion

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. THIS GIVEAWAY IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

By entering this giveaway, participants agree to abide by these official rules and the decisions of attaché x, which are final and binding in all respects. Failure to comply with these rules may result in disqualification.

1. Eligibility

  • The giveaway is open globally to individuals who have reached the age of majority in their jurisdiction at the time of entry, except where prohibited or restricted by law.
  • Employees, contractors, officers, and directors of the Sponsor, its affiliates, subsidiaries, advertising and promotion agencies, and their immediate family members (spouse, parents, siblings, and children) are not eligible to participate.
  • This giveaway is void in countries where local laws or regulations would restrict or prohibit it, or where it requires registration.

2. How to Enter

To participate in the giveaway, entrants must complete both of the following steps:

Each participant is limited to one entry. Multiple entries from the same individual using multiple email addresses or Instagram accounts will be disqualified. The Sponsor reserves the right to verify all entries and may, in its sole discretion, disqualify any entrant who tampers with the entry process or is otherwise found to be in violation of these official rules.

Incomplete or illegible entries will not be accepted.

Additionally, participants who purchase an attaché x bag on www.attachex.com during the giveaway period (from 5/10/2024 to 30/11/2024) and are selected as the winner will be eligible to a refund, as explained in Section 7 of these rules.

3. Entry Period

The giveaway begins on 5/10/2024 at 00:01 GMT and ends on 30/11/2024 at 23:59 GMT (“Entry Period”). Entries received after the end of the Entry Period will not be accepted.

4. Prize

One (1) winner will be randomly selected to purchase one bag from attaché x for £1.

Purchase for £1 Clause: The giveaway is structured so that the winner will have the opportunity to purchase a selected leather bag from attaché x for £1. This nominal fee is to comply with relevant legal regulations and ensure that the transaction is valid under applicable law.

The prize includes the following stipulations:

  • Shipping costs: All winners, regardless of location, will be responsible for shipping costs. The Sponsor will provide an estimate of shipping charges, and the winner must agree to cover these expenses before the prize is dispatched.
  • Customs and Duties: Non-UK winners may also be subject to customs duties, taxes, or other charges as required by their local government. The Sponsor is not responsible for these fees and will not cover them.

No Substitution or Transfer: The prize is non-transferable, and no cash alternative or substitution will be offered except at the Sponsor’s sole discretion.

5. Winner Selection and Notification

The winner will be selected randomly from all eligible entries received during the Entry Period. The random draw will take place within 5 working days after the Entry Period closes.

The winner will be notified by email or direct message via Instagram within 5 working days of the draw. The winner must respond within 5 working days of notification, confirming their eligibility and providing a valid shipping address. Failure to respond within this time frame will result in the forfeiture of the prize, and an alternate winner will be selected in the same manner.

The Sponsor is not responsible for any communication failures (e.g., winner’s spam/junk email filtering, incorrect email addresses, Instagram direct message failures) that prevent the winner from receiving the notification.

6. No Warranty, Return, or Trade-In Guarantee

Important Notice:

Unlike the standard terms that apply to purchased products from attaché x, the following policies do not apply to the prize in this giveaway:

  • No Warranty: The prize awarded through this giveaway does not include attaché x’s standard 1-year warranty. The prize is provided “as is” without any guarantees or warranties, express or implied.
  • No Free Returns: attaché x’s usual free returns policy is not applicable to the prize.
  • No Trade-In Value Guarantee: The prize is not eligible for attaché x’s future trade-in value guarantee. The winner will not receive any credit, value, or compensation in the future if they wish to trade in or exchange the prize.

By participating in this giveaway, entrants acknowledge and accept that none of these standard policies apply to the prize.

7. Refund for Purchases Made During Giveaway Period

If a participant purchases a bag from attaché x during the giveaway period or up to 10 days prior to the start of the giveaway, and is later selected as the winner, the following refund policy will apply:

  • To claim the prize benefits, the winner must agree to the conditions of Section 6 of these rules.
  • The winner’s original purchase price (excluding shipping fees and any applicable taxes or customs charges) will be refunded to the voucher prize level of £1 (or equivalent in currency used at the time of purchase), provided that the winner has met all the requirements of these official rules.

Refunds will be processed within 5 working days of the winner’s confirmation and completion of the necessary payment.

Important: The refund does not apply to any shipping fees, taxes, or customs duties incurred at the time of the original purchase. These costs will not be refunded, and the winner will remain responsible for any such charges.

8. General Conditions

  • The Sponsor reserves the right, in its sole discretion, to modify, suspend, or terminate the giveaway should fraud, technical failures, or any other factor beyond its reasonable control impair the integrity or proper functioning of the giveaway.
  • The Sponsor reserves the right to disqualify any individual it finds to be tampering with the entry process, engaging in fraudulent activities, or acting in violation of these official rules or in an unsportsmanlike or disruptive manner.
  • The Sponsor’s decision in relation to any aspect of the giveaway is final and binding. No correspondence will be entered into, except with the winner.
  • The Sponsor reserves the right to substitute the prize with one of equal or greater value if the advertised prize becomes unavailable for any reason.

9. Publicity

By entering the giveaway, participants consent to the use of their name, likeness, Instagram handle, and country of residence for promotional purposes without additional compensation, unless prohibited by law.

10. Privacy

The personal information provided by entrants in connection with this giveaway will be used solely for the purposes of administering the giveaway and in accordance with the Sponsor’s privacy policy. By entering, participants agree that their personal data may be used for promotional communications from attaché x, which they may opt-out of at any time.

11. Limitation of Liability

  • No Liability for Technical Errors: The Sponsor is not responsible for any technical errors, interruptions, deletions, defects, or malfunctions (whether human, mechanical, or electronic) relating to the giveaway.
  • Assumption of Risk: By participating, entrants agree to release and hold harmless the Sponsor, its affiliates, subsidiaries, officers, directors, employees, agents, and representatives from any liability, loss, injury, or damage, including personal injury or death, arising out of or related to participation in the giveaway or the acceptance, use, or misuse of the prize.
  • Taxes and Fees: The winner is responsible for any and all applicable taxes, customs duties, or other fees associated with winning and receiving the prize. The Sponsor is not liable for any of these costs.
  • Local Laws: Entrants are responsible for ensuring that participating in the giveaway does not violate any local laws in their jurisdiction.

12. Disputes and Jurisdiction

This giveaway and these official rules are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these official rules or relating to the giveaway will be subject to the exclusive jurisdiction of the courts of England and Wales.

By entering the giveaway, you acknowledge that you have read, understood, and agree to be bound by these official rules, attaché x terms and conditions, privacy policy, including the refund policy for purchases made during the promotion, and the limitations on warranty, return, and trade-in value policies.
